Terms and Conditions for SoBe Fit Body LLC (HS # 9878), located at 1618 Alton Road, Miami Beach, FL, 33139 , 305-915-7273 

All clients have to sign the liability waiver before attending their first class.

For hygiene and safety, no shoes are allowed on the studio floor.
For the Pilates Reformers class, we have a sock-only policy: regular cotton socks or yoga socks, are required for all classes and are available for purchase at the front desk.
Please arrive on time,class space will be given up to anyone on the wait list at the start of the class. For your safety, late entries are not permitted 5 minutes after the start of class.

  • First time students please allow 10-15 minutes to complete new client form prior to class
  • Refrain from wearing perfume and cologne and please wear deodorant  (Scroll down to read more) 

Cancellation Policy

There is a 12 hour cancellation policy on all regularly scheduled classes, 24 hours cancellation policy for private and semi-private appointments. If you do not cancel a class or appointment within this time frame, you will be charged in full.
Session Packs: for late cancels (less than 12 hours) and no-shows, one session will be deducted from the pack.
Unlimited Membership: late cancels and no-shows will be charged $25 to the credit card on file.
Reservations may be cancelled on line through the “My schedule” tab.

Once the liability waiver is signed, the client becomes a member of the SoBe Fit Body Studio.
SoBe Fit Body Studio has the absolute discretion to accept or reject a client as a member.
SoBe Fit Body Studio reserves the right to expel from the Studio or refuse to renew the membership of any member whose conduct is or may, be injurious to the character of the Studio in SoBe Fit Body reasonable opinion, or is in any way a breach of the Terms and Conditions. Any person so expelled will immediately cease to be considered as a member of the Studio and will not be entitled to any refund.

Reservations
Due to the limited number of available spaces in each class, reservations are strongly recommended and are available online.

All sales are final. Classes are non-refundable, exchangeable, or transferable. Unlimited Memberships and Multi-Class Packages cannot be shared.

Classes and instructors are subject to change without notice. There is a 2 person minimum for a class to be held. If you are the only client, you have the option of deducting a second class from your series and receiving a private class. This is a great opportunity due to the fact that private sessions cost several times a class. We recommend taking advantage of your teacher’s undivided attention to reap the benefits of a private class. Please make sure to check online for current class schedule.

Consumer Protection Clauses

A.This contract provides a penalty-free cancellation option within 3 days, exclusive of holidays and weekends, of its making, upon the mailing or delivery of written notice to the health studio, and refund upon such notice of all monies paid under the contract, except that the health studio may retain an amount computed by dividing the number of occasions health studio services are to be rendered into the total contract price and multiplying the result by the number of complete days that have passed since the making of the contract or, if appropriate, by the number of occasions that health studio services have been rendered. A refund shall be issued within thirty (30) days after receipt of the notice of cancellation made within the 3-day provision.
B. The contract provides for the cancellation and refund of the contract if the contracting business location of the health studio goes out of business, or moves its facilities more than five (5) driving miles of the business location designated in such contract at no additional cost to the buyer.
C. A notice of intent to cancel by the buyer shall be given in writing to the health studio. Such a notice of cancellation from the consumer shall also terminate automatically the consumer’s obligation to any entity to whom the health studio has subrogated or assigned the consumer’s contract. If the health studio wishes to enforce such contract after receipt of such showing, it may request the Department to determine the sufficiency of the showing.
D. The contract provides that if the Department determines that a refund is due the buyer, the refund shall be an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The business location of a health studio shall not be deemed out of business when temporarily closed for repair and renovation of the premises:
1. Upon sale, for not more than fourteen (14) consecutive days; or
2. During ownership, for not more than seven (7) consecutive days and not more than two (2) periods of seven (7) consecutive days in any calendar year.
A refund shall be issued within 30 days after receipt of the notice of cancellation made pursuant to this paragraph.
E. Disclosure: buyer should contact the Department of Agriculture and Consumer Services for information within sixty (60) days should the health studio go out of business.
F. The contract will be cancelled if the buyer dies or becomes physically unable to avail himself or herself of a substantial portion of those services which the buyer used from the commencement of the contract until the time of disability, with refund of funds paid or accepted in payment of the contract in an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The contract may require a buyer or the buyer’s estate seeking relief under this paragraph to provide proof of disability or death. A physical disability sufficient to warrant cancellation of the contract by the buyer shall be established if the buyer furnishes to the health studio a certification of such disability by a physician licensed under Chapter 458, 459, 460, or Chapter 461 provided the diagnosis or treatment is within the physician’s scope of practice. A refund shall be issued within thirty (30) days after receipt of the notice of cancellation made pursuant to this paragraph.
The contract provides that the initial contract will not be for a period in excess of thirty six (36) months, and thereafter shall only be renewable annually. Such renewal contracts may not be executed and the fee therefore paid until sixty (60) days or less before the preceding contract expires.
SHOULD YOU (THE BUYER) CHOOSE TO PAY FOR MORE THAN 1 MONTH OF THIS AGREEMENT IN ADVANCE, BE AWARE THAT YOU ARE PAYING FOR FUTURE SERVICES AND MAY BE RISKING LOSS OF YOUR MONEY IN THE EVENT THIS HEALTH STUDIO AND/OR THISBUSINESS LOCATION CEASES TO OPERATE. THIS HEALTH STUDIO IS NOT REQUIRED BY FLORIDA LAW TO PROVIDE ANY SECURITY, AND THERE MAY NOT BE OTHER PROTECTIONS PROVIDED TO YOU SHOULD YOU CHOOSE TO PAY IN ADVANCE.
